Pretty much when America is in danger the commander in chief is authorized to do whatever it takes to defend our borders.
I'm not trying to make a case for whether or not the President of the U.S. can issue a draft. Congress has the power to enforce that amendment but they also have the power not to, so it doesn't really matter. I'm just throwin' something out there to think about.
