NY set to pass Gun Control
NY seals 1st state gun laws since Newtown massacre
And the boys from NY come out swinging...
Quote:
|
Ammunition magazines would be restricted to seven bullets, from the current 10, and current owners of higher-capacity magazines would have a year to sell them out of state. An owner caught at home with eight or more bullets in a magazine could face a misdemeanor charge.
|
Quote:
|
Stores that sell ammunition will have to register with the state, run background checks on buyers of bullets and keep an electronic database of bullet sales.
|
Quote:
Under current state law, assault weapons are defined by having two "military rifle" features, such as folding stock, muzzle flash suppressor or bayonet mount. The proposal would reduce that to one feature, including the popular pistol grip. The language specifically targeted the military-style rifle used in the Newtown shootings.
Current owners of those guns will have to register them.
|
Quote:
|
New Yorkers also would be barred from buying assault weapons over the Internet, and failing to safely store a weapon could lead to a misdemeanor charge.
|
All I can say is...
1. I am glad I don't live in NY.
2. I am not sure if forcing people sell or destroy high cap magazines will fly.
3. Does NY have a 3 strikes rule? Or How many misdemeanor charges can you get before they become a felony offense?

The whole thing was basically NYC and downstate NY telling upstate to go **** themselves. The law is completely unconstitutional. However it's not like those hacks give a damn what the Constitution and general history have to tell. The problem now is that once it inevitably passes, most gun owners in the state of New York are felons. Cuomo said it himself he wanted confiscation door to door.
I worry that SCOTUS will not strike this down. Currently the balance is 5-4 in favor of the individual right to keep and bear arms. All it takes is for one of them to retire within the next two years and Obama will appoint some other minority-raced liberal in place.
The people of NY should be rioting around the homes of politicians who were in favor of this law.

Holy ****.
If we changed it to:
you may only speak if you have a license to do so
online postings must be approved by the bureau of speech
one conversation per day allowed
You'd claim it was unconstitutional.
"Shall not be infringed" is pretty ****ING CLEAR.

your right to own a gun isnt infringed, you just cant own a gun with certain specs thus it is (probably) constitutional...

Infringement of a right is still infringement of a right.
SCOTUS ruled you can't ban a classification of firearm with D.C. v. Heller. It will depend entirely on keeping the five pro-civil liberties justices in power. Once we can get a Republican back in power, it'd be nice to have some good people put in power. Ginsburg and Breyer are damn near close either death or retirement. I can only hope neither happens while Obama is in office.

Aside from the constitutionality issue of the ban, it's completely useless.
A) I can only kill 8 people (7+1) instead of 11? Oh wait, reloading in about 2-5 seconds.
B) Pistol grips, CAR stocks, etc. mean jack squat. I can as many or more people with a hunting shotgun with a rifle grip as opposed to one with a pistol grip.
C) Criminals aren't going to care. Even normal people won't care. This law does jack.
This is two strikes for New York. For the dumb soda law, then this. One more, and I say we give it back to the Indians.

It could and will likely be argued that it is a de facto ban on most semi auto handguns as 7 round magazines are not available for them.

This is such bull. This crap isn't going to save anyone's lives.
Let ban cancer! Make that sh**illegal. Cancer has no sporting purpose.. Just to kill.
It's sickening the way these liberals think, don't let a good crisis go to waste!
There's already laws that make the private transfer of handguns illegal, sure as hell hasn't stopped criminals from getting their hands on those!!
And there's roughly a 20:1 handgun to rifle murder ratio.
Fine work their doing here.

Only if they have a pistol grip or collapsible stock. Otherwise, they're harmless.
