Not really.. depends on value.. as long as you can prove that fraud was committed, it wont cost anything but gas money (at least in TN is how it works)

I don't want to take this excellent thread off to a tangent, but the problems with filing in the Small Claims Court are: There is filing fee in most states, you have to take time off work to be there at the court date, the defendants often are under-aged, the defendants live in a different state. Yes, for a $1500 marker it's probably worthwhile. Most cases brought to the Theft Report section is dispute over amounts of $30 to $300. Only occasionally it's over that.

I mean US customs tapes it back up with their tape, so i don't know what to do if I lost something due to customs, like even in general this example could be spread to like mexico or european countries

Lets say any country's custom's screwed up, you are out a X item. but who is to blame though assuming you didn't know if customs lost it or the seller did not include it and the seller didn't have a packing video?

The seller is responsible for the item arriving safely in the hands of the buyer, with one exception. The exception is: The buyer wants to skip the shipping insurance to lower the price of the item.

Ok since you are going to nitpick I suggest you get insurance on everything you ship out like I do. I also take chronoing, and boxing videos. Finally, I have become very good friends with my local post office lady. They know me as the Asian guy who is always Smiling. I have never ever lost a piece of mail. I have even shipped Airsoft guns to China without problems. So a little people skills goes a long way.

I think hth_1 is asking from the point of view of a buyer, not a seller. As a buyer all you know is that the item is missing from the package. Of course, no matter what the actual truth is, the seller will always claim that the item was in the package.
When you receive a package you'll be able to tell if it has been opened or not. If Customs opened it they're supposed to leave a note. If the package arrived intact without any sign that the package had been opened, and an item is missing that means the sender didn't include it.

No no no, just no. You are still responsible as the seller for purchasing insurance to cover the item. If you decide to lower your price and not purchase insurance then you are still on the hook. In these situations it is mainly to protect the seller.
