Yeah, he got the Assault charge 'cuz he came at me first, but because i put him down i also said to him that i was gonna kill him if i ever came across him again, so the police are charging me with the "Uttering Threats To Cause Death Or Bodily Harm"

bull**** like wtf he came at me ... but apparently i can't say that i intend to kill or injure him, it's against the law **** THAT **** but he left town so i'm not too worried.

Lmao. If they don't find him, he's the key "witness" so you'll probably walk. Granted, no, you're not supposed to say **** like that, but depending on how the trial goes, it could be considered an idle threat made in the heat of the moment. Just make sure that you are well groomed and dressed professionally when you go in there and Yes sir/ma'am EVERYTHING. Courtesy and professionalism win these kind of cases. You may end up with no charges at all, or with some minor community service or something stupid.

If you're a douchebag, you may end up with misdemeanor charges and some serious bull**** on your record.

They need to prove that you actually had the intent to follow through with your "threat". Opportunity, Intent, and Capability need to be proven, O.I.C.

Opportunity can be implied, for obvious reasons, Capability is obvious because you beat the **** out of him with your hands, so that leaves intent. If they can't prove that you intend to pursue him, they don't have anything on you. Don't go in cocky, just remember that in the back of your mind.

THanks bro, i hate going to court, i had a previous "Uttering Threats..." charge but a long time ago, back in ... wtf 1999 ?

i was burned out from wearing a suit and tie 5 days a week and started doing odd retail jobs and even an auto body shop, but my folks wanted to see me as a white collar (typical chinese) working behind a desk pushing pencils

they had me over for dinner and a "talk", my dad is hot tempered and i grew up watching him throw around plates of food, bowls of soup, slam my mom around ... anyhow the argument escalated into a physical altercation when i threw a wood chair and it broke a window

i called police on a cordless phone asking them to "mediate a domestic dispute" which they had done before without any incident, the 911 operator sez "ok the police are here to help, they are outside" i step out the front door and there are 5 cops with guns drawn ...

However neighbors called the police as well and they sent a SWAT team with scoped rifle and arrested ME, they thought the black cordless phone was a weapon

Yeah but having criminal charges suck even more, my passport expired and i don't think i could cross the border ... even though i was never convicted of any charges they stay on your record unless i apply to Pardons Canada ... one "Assault" charge and two "Uttering Threats" is kinda lame to explain, i even applied to jobs like shift manager at the local casino; part of the gaming employee application i had to divulge if i had any previous charges so i just gave up, it was embarassing because the casino kept phoning to ask when i could get my paperwork in and start work ...

Don't let that ruin your life. If you want something, go after it and get past the bull****. That or lay down and die. It's your decision, and will only effect your life if you let it.
