Yes, the marker can fire when it is degassed if there isn't a PCV in place, and no, it will make no odds if the marker is turned on or off, it can still fire when degassed.
The PCV is an important safety feature, and should be replaced immediately.
It's true of course that if your barrel sock is on whenever you aren't firing, you should avoid any accidents occurring, but none the less, I wouldn't feel comfortable using a marker that could fire at any time other than when I want it to.
