Where i live we don't have this sort of problem but we have gotten complaints from hunters before saying we scare off some of their game when we are playing near their hunting grounds but if you are playing mid day and the sun is out there should be no problem with noise unless it were at night and abnormal hours.

Unfortunately, these kinds of actions are all too common around the country when someone who has a basic misunderstanding of the game decides to take affront.

The best bet in these cases is to find some kind of out-of-court settlement with the "neighbor"; any attorney will tell you that the inside of a courtroom is a crapshoot. I've personally witnessed judges declare that they aren't going to follow or enforce a state's own laws. (Personalities and prejudices all too often make it past justice's supposed "blindness".

A field owner I worked with in Florida was subjected to this exact same thing - and worst. Neighbors complained that his field was an eyesore and damaging property value. The pictures they submitted as evidence were taken during the driest part of the year and during construction of the facility. Comparing them to "now" did NOT sway the oversite board. Pointing out the multiple, verifiable lies by the neighbor did not change opinions.

The field is no longer in business - but pig farms are now at the same location and ALL of the exhaust fans are blowing in the neighbors direction. (Moral of the story - be careful what you wish for.)

My advice is to nip this in the bud: try to arrange a sit-down with the neighbor and find out what the 'real' issue is. It could be something as simple as spillover onto her property or being awakened "too early" in the morning. (Pay-offs don't hurt either, lol), and, if worse comes to worse - check into local ordinances and zoning regulations with an eye towards developing counter-ammunition.

Also, you could try to have your children, and the children involved write a letter and have them apologize about there actions. As well as asking if there is anything they could do to help her to change her mind about the lawsuit. Such as helping around the house, you know. But make sure you make a copy of the letter you send her.

But mainly I think it was super messed up for her to pursue legal action over just coming over to your house. *****ing a fit, and telling you to stop or she would pursue legal action. It just seems very unlikely that she will get any money out of this incident without providing legal documentation that she has undergone psychological negative effects from your young children, and their friends playing a fun, and team building sport.

Sounds like you got hosed by your attorney.

I worked at a field that had 5 houses not more than 100 feet from the back fields. That was certainly legal, and not a nuisance (although I often felt it was when we were inflating those bunkers at 8 in the morning on Saturdays).

What your children were doing is so far away from a nuisance that I wonder why your attorney had to spend any time defending you. I figure 5 hours researching just to make sure, and another 5 hours to write it all up, and then 2 hours at trial, that should only be about $6,000.

It's your property do whatever you want. I had a neighbor call the police on me and my friends once because we were doing doughnuts on our four wheelers in the driveway and "kicking up to much dirt which was going across the road and getting on her car." We never left the property and the cop sided with us. We weren't doing anything wrong since it was my property. He told the lady it wasn't his problem as nothing wrong was being committed and he left. Simple as that. People have no ****ing business telling you what do to on your property.

I would counter sue for defamation of character, legal fee's, and the emotional stress this has caused you and your family.

True, but you can play paintball, not exactly sure the rules about it but paintball began as a backyard game, and it will more than likely continue to be such.

On another note, Ill come up from NC and gladly play a tourney there

Your neighbor is just a *****. You can't change her mind about it, and she is always going to complain whether you win the case or not.

Simple solution, move it to the other side of your 7 acre property. Paintball fields really shouldn't be longer than 300x200, even for a woodsball field. Just move the field and end her complaining.

problems like this should be solved in this manner:
take a $.25 bullet, a gun, hold it to the back of her head and start chanting Irish prayers for her...then.... kablaaaaammmm!!!

or you could use the shovel, concrete and loader idea as previously stated

i dont even see how the judge didnt throw this out the second he/she read it. paintball does not cause depression and theyre really not that loud, especially thru the woods. people should just mind their own business unles it is truely harming them....gotta love the radicals and gotta love how .001% (radicals) of the population of the united states are able to control what the other 99.999% of the americans who care, but arent over the top
