Well I looked up, Patents And Trademarks.
heres what we have to do.
As a simple cheap way to patent something I write it down and anything i want to add and mail it to myself and never open it. It will have the date on the postage and show its never been opened so in court the judge can open and have proof.

A trademark is what we need since it could be a product line yet here are the catches
1. It will either be $275-$350
2. It takes a while for it to come into effect
3. It may not be accepted based on the Attorneys moral judgement.
4. Even if it is rejected we wont see the money again.

Im gonna mail several things monday, as for as trademarking i really dont want to take that chance right now. maybe when everyones finances have leveled out. but if it didnt pass and theres a good chance it wouldnt, it would be like throwing money away...
