Small paint could be the issue.
There is a small spring loaded bar that goes across a small part of the top of the mag. This is what is suppose to retain your paint in the mag until it's been inserted into the marker.

Just to confirm: Do you have both the bar and it's return spring?

Are you remembering to lock the main magazine spring down before you put in the paint? Take the part that pushes the paint out of the mag and slide it all the way down until you can lock the tab to the side, then put in the paint. When you insert the mag the tab will automatically unlock.
