iBrikr will get it out. And only take it to Apple as a last resort. They wont be too happy you tried to mod it. Actually, you wont get any help because you voided your warranty.

Well, looks light you're out of luck man. Take it to Apple and claim it must be a malfunction. DO NOT SAY YOU TRIED TO MOD IT! By jail breaking it, which is obviously illegal, you void your warranty. Just say you were syncing it, turned it off and then it got stuck in the screen. They may give you a new one.

It's not illegal. It just voids your warranty. You're the owner of the product, so you can do whatever the hell you want to do.
