the driver will be get out of killing that women by hitting her with a car for two reasons, 1 he didn't mean to. 2 it didn't hurt because she died on impact.
by your standards it would work, right? i mean if he didn't mean to do it, then he can't be held accountable for his actions, right?

I heard she is suing ESPN, and X Games as well. Chances are it would be proven that he was negligent.

all i was pointing out in your original post was your reasons why it would get thrown out in court. just because he did mean to hurt her doesn't mean he can't be tried. the other part of what you said was that goggles can't really hurt someone, which is wrong. that was the whole primness of the argument and why i phrased the situations the way i did. I don't understand why it was so hard to figure that out.
