CRANE: it is my understanding that the base commander (in conjunction with the SF commander) establishes the appropriate base BAC limit. Some bases are ZERO TOLERANCE from what ive heard. You blow anything and its a DWI.
I havent heard much; but from my experience it is almost like AFIs when establishing vehicle laws with local and state legislation. What I mean is that you cannot take away but you can add. You cannot undermine local/state law since your vehicle codes come from that state. So if state law is .08% BAC the base commander cannot override that and say on base is .10% but can be more strict and establish the .05%
It not undermining if its setting a more strict standard. Then it gets into military law/civilian law and the whole shebang. It is really REALLY hard to change things like that ESPECIALLY if you have anything other than exclusive jurisdiction on your base.
Interesting question... I will follow up on this as I am curious. More than likely, state statutes might have changed so the base has to follow along with local and state guidelines.
