because the Pro division is the main attraction and teams like Dynasty, XSV, Impact, Damage, etc probably would not have attended if Evil and GI paint weren't provided to them

I think that a D1 team could be given paint by their pro squad if needed. Fair? Probably not since not all D1 teams are associated with a pro team.

the pros "own" the league therefore they make the rules that govern them and follow or don't follow them

No team in D1 was shooting it. Not even our team, XSV Influence was shooting it. They were shooting the Valken Pro. The only other D1 team that had any level of access to the evil was Dynasty 2.
