condom help... no shes not pregnant.
kind of a random question. Was wanting to start making some condoms but wasnt sure if i could get sued for whatever reason. I would have to assume this couldnt happen as the field would have to approve anything used as a "legal barrel blocking device". my only thought is if someone is playing on a personal field and for some crazy reason one failed. could i in any way be held liable?
also... is there a patent i need to be worried about? thanks for your time.

Hahah.... I was just thinking bout getting some manufactured for our field.... that's a question I didn't think about..... but I would assume it would be the manufacturers fault not the field....... to add to that question....
IF....
it's kewl to have your own barrel covers.... where's a good place to have 'em made?

The manufacturer, you, will be responsible for them.. If your design has a flaw and doesn't block a ball, hits someone in the eye, etc.... bad for you... As a manufacturer I carried liability insurance to cover such cases.
And if you are producing anything, there are potential patent issues, but realistically, if you are doing something on a small scale for yourself - any patent holders will probably never even find out. Now if you start selling them on line, and take ads, for example here.... might be a different story.

Barrel covers are patented. Larry Cossio is the original patent holder. IIRC Nelson Paintball now owns the patent.

so you have to get permission to use the patent? Another thing... if it works once will it then be the person using the condoms neglect that would keep me out of trouble if it did fail because ive seen people use condoms to its death after years of use and shoot right through them? and how do you patend stich work? if i stich it different is it not a different product then what the patent is? is the patent just any sleave over the barrel?

As far as the patent goes, you would have to find it to see what is patented, and find out who owns the patent to find out usage requirements. Could be concept or materials or design, tough to say unless someone looked it up. I have seen a few variations on the "basic model", I have also seen plastic ones that had a "finger" that went a little (1") down the barrel to ensure the paint broke.
With liability, it's tough to say, if you make a poor design it will come back on you, if someone uses it past it's prime then it would probably go to court.

If you would like an example, I just took 2 pictures of my old jersey. It was made at least 3 years ago by animal paintball, took a full season of play and just unfolded it out of my closet 2 days ago and still amazing shape. Animal Paintball is a great company.

When it comes down to it, it's too easy to just buy some that are already out there instead of having attorneys analyze patents, and then try to afford production that cannot be as cheap as off shore sewing...
If you want to give it a shot, there is a link to the patent off our safety page http://www.gatsplat.com/safety.asp and don't forget to make sure you comply with ASTM F2271 - 03 Standard Specification for Paintball Marker Barrel Blocking Devices
http://www.astm.org/Standards/F2271.htm

In my case i think it's a terrible idea. Some of the best reffs i hire do not play paintball. I teach them exactly how i was things done and they don't have a preconcieved notion of how a player could do it better
