Court Tips?

I had a clean record until March, then things went to hell I guess. I got three different citations during the month, which is crazy; sucks living on a college campus.

The first thing I got was a seatbelt violation which I paid the fine for, so no worries with that.

A few days later I got a underage possesion/consumption of alcohol. Honestly, the cop cut me a HUGE break. I was walking down the street with a beer in my hand, and then I just decided to take a piss in my friends yard, but I didn't get charged with public urination, etc. I honestly accept acting like an idiot for this situation and also accept a consequence. I have court in June for it though, and was wondering what I should do for that. I wasn't breathalyzed, but I admitted to having a few beers. On top of what to do, any estimates on the fine?

Two weeks later I was heading home from a lacrosse game, and I was "pulled over". When, in fact, I was in my spot and out of my car by the time the officer pulled up behind me (I have a witness to say this too, the cop even spoke to him). He told me to get in the car, grab my license and registration and then told me I was going 21 in a 10. From where he was sitting (yes, I saw him) there was no possible way that he could say I was speeding, absolutely no direct path for the radar. The road is 25, then at the top of the hill is 10 (by then I am looking for a spot, why the hell would I be going 21 mph?). Anyway, my door was still open when he stuck his head in and saw a small bit of marijuana on the back floor mat (not mine, even went through my colleges judicial system and it was proven that it was not mine). He cuffed me, searched my car and found nothing. I got back in my car and waited for the citation, which he wrote up and was for $90 and would end up being for two points. Court is in July and I was curious as to how to approach it, and also, could the officer bring up the marijuana and that affect what the outcome is?

dress really nice, and dont smoke 2 weeks before your court date, just incase.. cause then you could just be like i don't use marijuana sir and you have piss to back you up.

Check out the link in my sig labeled 'FindLaw' (it goes to findlaw.com), you can easily research listings of lawyers local to you and find one that specializes in your issue, or just find the cheapest.

In a parking lot. There's no possible way that I was even going 21 mph after the sign since the spot I parked in was maybe 10 feet after it.

Did you admit that it was marijuana? Did he take it as evidence? How much was it, an unweighably tiny amount or like a full nugget?

First of all, for the ticket part, one thing that the prosecuting side did against me in court was that they had one of those large presentation pads on an easel and they drew out a map of the intersection and whatever they were trying to convict me of a median violation. If there really is a physical reason why the cop couldn't have seen you speeding, then you should print out an overhead view of the "crime scene" from google maps and note where the officer was and where you were and present it.

And yeah for the marijuana depending on how substantial it was I would say that you should deny knowing anything about it and knowing that it was marijuana and say that you don't smoke and would volunteer to submit to a drug test.

Why did you admit to drinking a few beers when you got stopped for drinking? I'm in college right now and the way people fold under pressure to police astounds me. In my experience cops write drinking tickets to college students because they know most of them will just plead guilty and pay the fine. Around my college If you are with somebody who has beer and the cop stops them they will just write you a drinking ticket assuming that you were drinking because they know most kids will just pay the 300 dollars. Problem is, in IL you lose your license for 3 months for under drinking offenses.

He did a field drug test for the weed, but it was an unweighable amount. He wrote in the report that I had it in my car, but I wasn't fined or anything for it luckily.

I took pictures today of from where the cop was sitting and am also doing the overhead view as well.

As I said, it was obvious that I was drunk since he caught me urinating on my friends yard with a beer in my hand, so thats how he caught me.

Try pleading it down. You may be able to get some BS parking ticket. I plead down a 75 in a 55 to a $65 parking ticket myself. Anything to skip points and insurance increases.

Get an overhead map of the area and ask specifically where the cop was sitting. Ask specifically where he tagged you. Show the overhead map and that the line of sight is obstructed. Back this up with pictures from the scene.

If not ask for the radar detctors certification, his cert, and the technicians certification.

I'm assuming there are consequenses beyond just the fine(s). Could you loose your license? Other consequenses? You need to balance the cost of the fines vs the value of the other consequenses. If the other consequenses are important enough, you need to pony up for a lawyer.

My son got his 2nd out of state speeding ticket on top of a seatbelt violation and another violation that he had been given 'court supervision' for (In IL you can get court supervision for a first offence and if you stay clean for 6 months the violation is dismissed).

If convicted, he would have lost his license for a minimum of 6 months and our insurance rates would have gone through the roof. Even though a lawyer cost well more than the fines would have, he was able to get the charge dismissed.

If you do need to go to court, get dressed up, be polite and respectful to the judge, and if possible have a parent accompany you (this carries more weight with judges than you would guess).

I brought up the idea of a lawyer with my parents and they don't think its worth it, but I still debating hiring one. My dad is coming with my for both my court dates as "moral support" which is code for "make sure you don't **** up", but I'm still grateful for that.

You should have a lawyer on retainer for things like this... I can't tell you how many people have come through here asking the same questions you are.
