Here's some better details on the whole issue between the two:
Status
MEMORANDUM
To: All Dealers
From: One Group International, Inc.
Date: Aug. 12, 2004
Re: Our current situation
First of all, we would like to apologize to each of you for the drama that is unfolding in a public way, which either directly or indirectly affects you all. At this point, we feel that a response is needed to address several false and misleading claims made by
Odyssey Products International, L.P., Garland, TX location, and one or more of its employees/representatives.
Recently, the above mentioned parties began contacting dealers across the country in an effort to re-route existing accounts receivable for markers they have no right to. We acknowledge that, and have stated, if monies are owed for loaders, please send that payment to the Garland, TX office. If, however, monies are due for markers, those payments MUST be made to the Mobile office.
Please understand, One Group International (OGI) has always maintained control and possession of all marker inventory, sales staffing, and distribution location. For the record, Odyssey Products International, L.P. was formed to distribute in a mutual fashion, the products offered by Odyssey Paintball Products (loaders) and One Group International (markers, accessories, soft goods). In addition, the new formed group would develop a line of products under the “Odyssey Signature Series” which would tie the two groups together. It was decided that the name “Odyssey” would be continued in this new group because of the brand equity that existed, having the best loader on the market. Other than a few suggestions regarding the outlook of the markers, all designs were that of Michael Spurlock.
He (Michael) began training some of the Odyssey staff in the manufacturing of markers. By their own admission, what they know today about producing paintball markers, they learned directly from Michael Spurlock. This brings us to the next issue. Just a few days ago, www.ogi.tv, the website for Odyssey Products International, displayed One Group International markers (TES, The ONE, TES B, TES X) with new names. They are claiming ownership of these markers as their own (clearly misleading).
Lastly, the most recent letter received by many of our dealers is “from” a man claiming to be the manufacturer of the markers in question. Many slanderous claims were made in this letter which have far reaching legal ramifications. Needless to say, there has been no “embezzlement” of any monies. Also, you should not feel at risk in purchasing markers from us, as many of you have been doing faithfully for the past 3 years. We expect this situation to be resolved in the very near future. Thank you as always for your continued support.
